The Appellate Tribunal for Electricity (APTEL) quashed Maharashtra’s 2,000 MW/4,000 MWh BESS tender, ruling that a post-bid Ministry of Power condition requiring contractual rights over 6,300 battery cycles materially altered tender terms after bids were submitted. The Tribunal held that such changes undermined bid certainty, affected project economics and VGF eligibility, and violated fair bidding principles.
